This policy complies with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 on the Protection of Personal Data and the guarantee of digital rights (LOPDGDD).

This website does not use registration, user accounts, advertising or tracking cookies. The contact form does not send data to any server: when you submit it, your email application opens with a pre-filled message that you review and send yourself. Nothing reaches the owner until you send that email.

If you write to the owner, the data you provide (such as your name, email address, organisation and the content of your message) are processed to answer your enquiry and, where relevant, to prepare a proposal for a talk or other service.

When you visit the website, the hosting provider processes technical data such as your IP address, browser type, requested page and date and time of the request, in server logs needed to deliver the site securely.

The website also uses Vercel Web Analytics and Vercel Speed Insights to measure audience and performance. They are cookieless and do not store personal data on your device or build profiles of visitors across sites.

Answering your enquiry: your consent, expressed by sending the message, and the pre-contractual measures you request (article 6.1.a and 6.1.b GDPR).

Hosting logs, security and aggregated statistics: the legitimate interest in operating a secure website and understanding how it is used (article 6.1.f GDPR), with minimal impact on your privacy.

Where a contract is later agreed, the processing needed to perform it and to meet legal tax and accounting obligations (article 6.1.b and 6.1.c GDPR).

Your data are not sold or shared for commercial purposes. They may be accessed only by service providers acting as processors under a data processing agreement:

Vercel Inc., which hosts the website and provides the analytics and performance measurement.

The email service provider used by the owner, which stores the messages you send.

Public authorities, where there is a legal obligation to disclose data.

The website is delivered through Vercel’s global network, so technical data may be processed in countries outside the European Economic Area, including the United States. Such transfers rely on the safeguards offered by the provider, such as the EU-US Data Privacy Framework or the European Commission’s standard contractual clauses. The same applies to the email provider if its servers are outside the EEA. No other international transfers are made.

Emails and the data they contain are kept for as long as needed to handle your enquiry and, if a relationship follows, for the period required by law (for example, six years for accounting records). Afterwards they are deleted or blocked during the limitation periods for possible liabilities.

Hosting logs are kept for the short period set by the provider and then deleted or anonymised.

You can exercise your rights of access, rectification, erasure, objection, restriction of processing and portability, and withdraw your consent at any time, by writing to hola@samhernandezgarcia.com and identifying yourself. Withdrawing consent does not affect the lawfulness of processing carried out before.

If you believe your rights have not been respected, you have the right to lodge a complaint with the Spanish Data Protection Agency (AEPD), C/ Jorge Juan, 6, 28001 Madrid, https://www.aepd.es.

The owner applies reasonable technical and organisational measures to protect your data, including encrypted connections (HTTPS) and restricted access to the mailbox. Please avoid sending sensitive personal data by email.
